Terms of Service

2. Eligibility

The current Momenti closed beta is intended for users in the United States who are 18 years of age or older. By using the beta, you confirm that you are at least 18.

3. Identity and accounts

Momenti has three practical identity states:

• Signed-out viewer. You can open an accessible Unlisted Moment and see its limited preview without an account.
• Guest contributor. When a signed-out person takes an action that requires an identity — for example submitting a photo or a report — Momenti may create an anonymous account for them. This is a real account identifier held on Momenti's systems; its session is tied to the browser or device it was created on. Clearing that browser's data, or switching devices, can make a guest identity unreachable.
• Permanent account. An account created with email and password, or with Google sign-in.

Where the flow is available, a guest may upgrade their existing identity to a permanent account through Google or email sign-in. Upgrading keeps the same underlying account; Momenti does not merge two separate accounts together.

Creating or hosting a Moment requires a permanent (recoverable) account.

You are responsible for the security of your account and your sign-in email, and for activity that occurs through your account or guest identity.

4. Moments, access and contribution

Access. An Unlisted Moment is reached through a direct link, a QR code, or its 6-character Moment code. Anyone who obtains that link, QR code or code may be able to open the Moment. Share them only with people you intend to include.

There is no Private/invite/approval access mode and no Public directory in this beta.

Preview. A person who has not contributed may see a limited preview of a Moment's photos rather than the full gallery.

Contribution. A contributor is a user who currently has at least one successfully published photo in that Moment. Contributor status is automatic and follows from publishing a photo — Hosts do not appoint contributors. Opening a Moment does not by itself make you a contributor.

Full access. Full gallery access is available to the Host and to current contributors, according to the access rules in effect. Access is evaluated when content is requested; it is not a permanent grant, and it can change — for example if your only published photo is removed.

Holding a link does not give you permanent or unrestricted access to every underlying file.

5. Your content and the rights you give us

You keep ownership of the photos you upload.

You grant Momenti only the rights reasonably necessary to operate the service for you: to receive, process and re-encode, store, and display your content to the people entitled to see it in the relevant Moment, and to make the operational copies required to provide the service, such as resized derivatives. This licence exists so that Momenti can run the service. It ends when your content is removed from the service, except where a copy must be retained as described in section 7.

Your responsibilities. You are responsible for having the rights, permissions, or other lawful basis applicable to the content you upload, and for respecting applicable privacy and publicity rights of the people who appear in it. Consider whether the people in a photo would expect it to be shared with everyone in that Moment, and do not upload content where you have no lawful basis to do so.

Processing. Photos are processed in your browser before upload and re-encoded into JPEG derivatives. Because of that re-encoding, embedded metadata such as EXIF and GPS location is not preserved in what is uploaded. This is a consequence of how Momenti processes images; it is not a guarantee that a photo cannot be identifying in other ways.

6. Acceptable use

Do not:

• upload content that is illegal, or that infringes or violates someone else's rights;
• upload content that is abusive, harassing, hateful, sexually explicit, or that depicts or promotes harm;
• harass, threaten or abuse other users;
• attempt to disrupt, overload, probe or interfere with the service, or to circumvent its access, rate or abuse limits;
• use automated means to access, scrape or bulk-collect content;
• attempt to reach Moments, media or accounts you are not entitled to access;
• evade a removal or restriction applied by a Host or by Momenti.

7. Roles, reporting and moderation

Roles. A Moment has a Host (its creator) and contributors. There is no Admin role in the beta, and Hosts have no kick, ban or participant-removal feature.

Reporting. Any user who can see a photo can report it. Reports are rate-limited to prevent abuse.

Host removal. A Host can remove media from their own Moment, including media uploaded by someone else. An uploader can remove their own media.

Momenti moderation. Momenti may review reports and may remove or restrict content, disable a Moment, or suspend an account, where we consider it necessary to enforce these Terms, to protect users, or to comply with law. Disabling a Moment makes it unreadable and closed to further uploads.

Users are responsible for the content they upload. Momenti does not routinely pre-screen user content, but may review or moderate content as described above.

8. Removal, retention and deletion

Removing a photo takes it out of the visible Moment. It does not necessarily mean that every copy is destroyed at that moment.

• Records of a removal (including who removed it and when) may be retained for moderation, security, audit, legal obligation, or operational purposes.
• Underlying copies of stored files may remain in our systems for a period after the photo is no longer visible. For example, when a Host removes someone else's photo, the Host cannot delete that uploader's stored copies directly; those files may be removed later as part of our operational cleanup processes.
• Access to media uses temporary signed URLs. These expire, but a URL that was already issued may remain usable until it expires, even after the underlying content has been removed or your access has changed.

We do not promise an immediate or fixed permanent-deletion timeline during the beta.

9. Account deletion and termination

There is no self-service Delete Account control in the current beta. To request deletion of your account, email maya@momenti.me. Deletion requests are processed manually during the beta.

When an account is deleted, certain safety, security or operational records may be retained or de-identified where appropriate, as described in section 7 and in the Privacy Policy.

You may stop using Momenti at any time. We may suspend or terminate access if you breach these Terms or where necessary to protect the service or its users. On termination, your right to use the service ends.

10. Beta status, availability and disclaimers

Momenti is a closed beta and is provided as is and as available, without warranties of any kind to the extent permitted by applicable law. We do not guarantee that the service will be uninterrupted, error-free, or that content will be preserved. Do not rely on Momenti as the only copy of a photo you care about — keep your originals.

Beta features may change or be withdrawn without notice.

11. Changes to these Terms

We may update these Terms. If we make a material change we will make a reasonable effort to notify users through the app or by email. Continuing to use Momenti after an update means you accept the updated Terms.
